LOUISVILLE, Ky. - Federal prosecutors could seek the death penalty for a suspect that allegedly gunned down two people at a Kroger store in Jeffersontown last October.

Gregory Bush appeared in court Monday, but no official decision has been reached in the case. The Department of Justice says the U.S. Attorney will make a confidential recommendation on whether or not to seek the death penalty.

Bush faces state and federal charges in the shooting that claimed the lives of Maurice Stallard and Vickie Lee Jones.

Doctors ruled Gregory Bush competent to stand trial last month. Jefferson Circuit Judge Annie O'Connell will decide whether to accept the findings of the report at an October 31 competency hearing.
