MILWAUKEE— As much of the country Tuesday watched the opening statements in the ongoing criminal trial of Kyle Rittenhouse in Kenosha, John Gross, a clinical associate professor at the University of Wisconsin School of Law and director of the Public Defender Project, focused on certain details others may have missed.

"Both sides are staking out their positions as they go forward in the trial," Gross said. "I think you can expect them to revisit these arguments at the close of trial for closing arguments."

Gross also warned people not to put too much stake into Tuesday's opening statements when it comes to the impact on the jury's eventual verdict, acknowledging there's a lot still to come throughout the trial which could sway their decision.

"They are just argument and the jury hasn't seen any actual evidence yet," Gross added, "so the judge will caution them and say, "Look— this is just what the parties think the evidence is going to show. You're going to have to determine for yourself at the end of the trial what you think the evidence has shown in the case."
