MILWAUKEE — While the Wisconsin Supreme Court struck down Gov. Tony Evers’ statewide mask mandate, local face covering ordinances are still in place.

The Wisconsin Supreme Court on Wednesday ruled 4-3 that the governor exceeded his authority by unilaterally extending the mandate for months through multiple emergency orders.

The statewide mandate was initially set to expire April 5, but now ends immediately. However, city and county mandates remain in place.

Milwaukee

A citywide mask ordinance remains in effect throughout Milwaukee through the MKE Cares Act. Free masks can be found at milwaukee.gov/masks. The ordinance went into effect July 16, 2020 and will be enforced throughout the duration of the Moving Milwaukee Forward health and safety order.

Dane County

Dane County remains under a face covering requirement for people five years of age and older, who must wear a mask or face covering:

  • In any enclosed building where other people, except for members of the person’s own household or living unit are present

  • In line to enter any enclosed building

  • Driving or riding in any vehicle where other people, except for members of the person’s own household or living unit are present

  • Outdoors at a restaurant or tavern

  • Outdoors while actively participating in sports, including drills, practices, scrimmages, games, and competitions.

  • Outdoors while attending a gathering of more than fifty (50) individuals.

Fully vaccinated individuals must continue to follow all other aspects of the order, including wearing face coverings and physical distancing when in public.

La Crosse

Everyone age five and older is required to wear a face covering in an enclosed space with people who do not live in the same home. They are also strongly recommended in all other settings, including outdoors when it is not possible to maintain physical distancing.

Brown County

Brown County health officials issued a health advisory effective immediately to encourage people to continue wearing masks. It is not an order or a mandate; Brown County Public Health cannot issue an enforceable mask order without authority from the County Board being provided in the form of an Ordinance.

Eau Claire

The City of Eau Claire and Eau Claire County adopted a face covering ordinance that would go into effect if the face covering orders issued at the state level were vacated. These ordinances require any person who is age five or older, and who is located indoors or in an enclosed space, other than a private residence, to wear a face covering. These ordinances remain in effect until June 30 unless otherwise noted.

Rock County

An order went into effect on Feb. 4 requiring people, ages five and older, to wear face-coverings indoors or outdoors in enclosed spaces. The order is set to expire on May 5.

Winnebago County

A health order was issued on Feb. 6 requiring everyone age five and older to wear coverings in public with people who are not in their own households. A face mask ordinance is also in effect for Oshkosh through April 30.

Kewaunee County

The Kewaunee County Public Health Department issued an advisory encouraging individuals who are at high-risk of contracting COVID-19 to continue to wear a face covering when in a public setting or when they are unable to social distance from individuals outside of their household to reduce their risk of exposure to the virus.

Marathon County

Marathon County health officials issued a face mask advisory for those five years and older. This advisory is in effect as of April 1, 2021 and will be reviewed after 60 days.
