SPRINGFIELD, Ohio — A criminal charge has been filed in Clark County against the driver of a van who was involved in a school bus crash Tuesday, which killed one student and injured 23 others.
Documents filed Wednesday show Hermanio Joseph, 35, is facing a charge of felony vehicular homicide. It's labeled as a fourth-degree felony in the documents, and not a misdemeanor. Ohio law states it's a fourth-degree felony if the driver didn't have a valid driver's license or had it suspended at the time.
The criminal complaint shows the penalty would be six to 12 months in prison and/or a $5,000 fine. Ohio State Highway Patrol said he was placed in the Clark County jail.
According to Sgt. Tyler Ross of OSHP public affairs, the bus was transporting 52 students to Northwestern Local Schools. At approximately 8:16 a.m. Tuesday, the bus was traveling down Troy Road — also known as State Route 41 — when a Honda Odyssey driving eastbound crossed over the center line.
To avoid contact, the bus tried to go off the right side of the road but still collided with the minivan, which was being driven by Joseph. The bus then overturned.
Officials said 22 students had non-life-threatening injuries, one was seriously injured and another student died at the scene. The injured students were transported to a local hospital for treatment. Joseph and his passenger, Roberto Mompremier, 37, were also taken for treatment.
Northwestern Local Schools canceled classes Wednesday, but opened at 8 a.m. to those who wanted to talk with grief counselors at the school.
The investigation is ongoing, officials said. OSHP hasn't released an official crash report as of Wednesday afternoon.
