CLEVELAND — A grand jury indicted four East Cleveland on-duty police officers on Tuesday for charges including tampering with evidence, obstructing justice, dereliction of duty and interfering with civil rights according to the Cuyahoga County Prosecutor's Office. 

County Prosecutor Michael C. O'Malley made the announcement that East Cleveland Police Officers Kyle Wood, 32, Daniel Toomer, 33, had been indicted and officers Tyler Mundson, 30, and Brian Stoll, 31, had additional charges added.

On March 31, Mundson attempted to execute a traffic stop on the victim, 32, and was assisted by Stoll, Toomer and Wood in the pursuit. The pursuit ended near Galewood Avenue and Ingalton Avenue in Cleveland where the victim was arrested. 

Wood reported initially that during the pursuit, the victim hit the front of Wood's cruiser. Body camera video revealed the victim had both hands out the window and parked his vehicle, complying with officers' demands. Woods and Stoll then forcefully removed the victim. Body camera video also showed Wood rammed the rear side of the victim's vehicle.

Per the indictment, Wood and Stoll then assaulted the victim, punching and kneeing him in his head and torso while Mundson assisted in hand-cuffing the victim. Wood later falsely radioed dispatch and said the victim hit the front of his cruiser and was resisting arrest. 

Upon arriving at the station, Stoll took the victim's phone, which he had been using in an attempt to record the incident, and smashed it over an object in the cruiser, bending the phone and cracking the screen. 

On April 10, Toomer attempted to execute a traffic stop on another victim, 25, in East Cleveland. Wood and Stoll, in a second police cruiser, and Mundson in a third cruiser assisted in the pursuit which ended near 152nd Street and Lakeshore Boulevard in Cleveland.

Officers initially reported the victim hit the police cruiser driven by Wood, causing him to spin out during the pursuit. Body camera video revealed that Wood hit the victim’s vehicle causing the crash and the video also revealed that during the arrest the victim was not resisting verbal commands and had both hands in the air. 

Stoll removed the victim from his vehicle and assaulted him alongside Wood, according to the announcement. The victim called 911 from his cell phone after telling officers on scene he needed medical attention. Cleveland EMS arrived and were sent away by the East Cleveland officers who said no one on scene needed medical assistance. 

The Cleveland Division of Police responded to the scene and East Cleveland officers obstructed Cleveland Police officer’s attempts to view the victim’s injuries. The victim was transported to a nearby hospital to be treated for his injuries after Cleveland officer's called for EMS despite East Cleveland officers' refusal.

  • One count of Felonious Assault
  • One count of Obstructing Justice
  • Two counts of Telecommunications Fraud

Tyler Mundson was indicted on:

  • One count of Theft In Office
  • Two counts of Tampering With Evidence
  • One count of Assault
  • Two counts of Interfering With Civil Rights
  • Two counts of Dereliction Of Duty
  • One count of Obstructing Justice

Brian Stoll was indicted on:

  • One count of Theft In Office
  • One count of Tampering With Evidence
  • Two counts of Assault
  • Two counts of Interfering With Civil Rights
  • Two counts of Dereliction Of Duty
  • One count of Felonious Assault
  • One count of Obstructing Justice

Daniel Toomer was indicted on:

  • One count of Theft In Office
  • One count of Tampering With Evidence
  • One count of Assault
  • One count of Interfering With Civil Rights
  • One count of Dereliction Of Duty
  • One count of Obstructing Justice
  • One count of Tampering Records
  • One count of Disrupting Public Service

Wood, Mundson, Stoll and Toomer will be arraigned at the Cuyahoga County Justice Center at a later date.
