An NYPD sergeant is facing manslaughter and other charges for allegedly throwing a picnic cooler at a fleeing suspect last year, fatally knocking him off a motorized scooter, officials said Tuesday.

Erik Duran, 37, has been charged with second-degree manslaughter, first- and second-degree assault and criminally negligent homicide in connection with Eric Duprey’s August death, New York State Attorney General Letitia James said in a press release.

The Putnam County resident, who police said was arrested Tuesday morning, pleaded not guilty to the charges before a judge in court Tuesday.

Dozens of NYPD officers showed up at Duran's arraignment to express their support. Duprey’s loved ones were flanked by their attorney and activists outside the Bronx courthouse.

“This has been a terrible ordeal for them. Every day has been a living nightmare and they’re happy that at least something is being done,” said Jonathan Roberts, the family’s lawyer.

A judge set bail at $150,000 cash or bond, James’ office said.

Asked about the incident at a press briefing Tuesday, Mayor Eric Adams said James would "make the final determination on how to move forward."

"That's not a policy that we use, throwing a cooler, but the [attorney general] is handling that, and I think it's best to, you know, I'll refer those questions over to the attorney general," Adams said.

Duran is accused of throwing a picnic cooler at 30-year-old Duprey as he attempted to flee arrest during a “buy-and-bust” anti-drug sale operation in the Bronx on Aug. 23, the NYPD said.

"Duprey had every opportunity in the world to slow down, stop, move out of the way, get off the sidewalk. But instead he drove directly at Sgt. Duran, as well as two detectives who didn’t know he was coming," said Andrew Quinn, Duran's defense attorney.

The cooler hit Duprey in the head as he rode a motorized scooter toward West 190th Street in Fordham Manor, police and James’ office said.

After the cooler hit him, Duprey lost control of the scooter, sideswiped a tree and flew off the vehicle, hitting his head on a curb, according to James’ office. Emergency responders pronounced him dead at the scene, the NYPD said.

The NYPD suspended Duran without pay and then placed him on modified duty as the department and James’ office investigated the incident, the release said.

Duran could face up to 25 years in prison in connection with the incident, James’ office said. He is set to appear in court again on April 18.
