Lawson is charged with tampering with evidence and conspiracy to commit murder. Nelson Circuit Court Judge Charles Simms ruled in November that he will be tried separately from his son, Joseph Lawson, and Brooks Houck, who is charged with Rogers' murder and was her boyfriend at the time of her disappearance.

A motion filed in Nelson Circuit Court said Darren Wolff, who represents Steven Lawson, previously expressed concern with the trial's scheduled date of Feb. 11; however, he didn't want to "show bad faith" and request to delay it. Wolff and Zach Buckler have represented Lawson since August after he fired his previous lawyer, Ted Lavit.

Wolff and Buckler argue in the motion there is still a substantial amount of evidence they need to review with Lawson, including the entirety of a 10-terabyte external drive from the federal government. They say delaying the trial will ensure Lawson will receive a "full and fair defense in anticipation of trial" as opposed to its current date.

Arguments on the motion will be heard at a hearing Thursday, Jan. 9 at 9 a.m.

"A jury trial so soon will unquestionably deprive Mr. Lawson and his counsel of the time necessary to conduct a sufficient review of all discoverable items, consult with any potential expert witnesses and provide Mr. Lawson with the defense he is entitled to," the motion reads.

Rogers, a 35-year-old mother of five, is presumed dead. Her car was found abandoned on the Bluegrass Parkway, and her body has never been found.
