Before President Donald Trump ordered a 90-day pause on his sweeping tariffs for most nations, except for China, he declared a national emergency over the United States’ trade deficits, which is being used to justify the president’s powers to implement those tariffs.

According to the U.S. Constitution, only Congress holds the “power to lay and collect taxes, duties imposts and excises” as well as the power “to regulate commerce with foreign nations.”

Some lawmakers and legal experts are questioning the president’s broad legal authority.

They say Trump is abusing his emergency powers and that Congress should step in to reclaim that authority.
