WISCONSIN— The Trump campaign officially filed its lawsuit in Wisconsin Tuesday, looking to overturn hundreds of thousands of ballots.

That suit was filed with the Wisconsin Supreme Court. It's looking to disqualify more than 220,000 ballots in Wisconsin's most democratic counties, Dane and Milwaukee Counties.

We spoke with Marquette University Law School Professor, Atiba Ellis about the lawsuit which he called an "uphill battle" for the campaign to substantiate.

Ellis said he's not sure the lawsuit has a leg to stand on.

"I find it hard to think that the Wisconsin Supreme Court wants to second guess the decisions made by election administrators trying to fairly administer an election in the midst of a pandemic. I'm hard-pressed to see where the evidence here is," Ellis says. 

Tuesday afternoon the Wisconsin Supreme Court asked the governor for his response to the petition.

"They're going to weigh the petition and the governor's response and make a decision on whether to go forward to hthe ear argument or decide that they don't have a basis on which to decide," Ellisa says. 

The Supreme Court can also choose to dismiss the suit.​
