TEXAS — A grand jury indicted Jerry Hernandez, a concrete truck driver, on multiple charges, including manslaughter and negligent homicide, following a deadly collision with a school bus on March 22, according to the Austin American-Statesman.

The crash resulted in the deaths of 5-year-old Ulises Rodriguez Montoya and Ryan Wallace, whose SUV was hit by the cement truck.

Hernandez is being held in the Bastrop County Jail.

The crash happened when a school bus carrying 44 Tom Green Elementary pre-K students and 11 adults were returning from a field trip to the Bastrop Zoo when the concrete truck veered across the double yellow line and forced the school bus to swerve, resulting in the bus skidding and rolling over before finally stopping upright.

According to Eric Wright, the school district superintendent, 51 individuals, including the bus driver, were injured, in addition to the two fatalities.

The concrete pump truck veered into Ryan Wallace’s vehicle behind the school bus and crushed it.

According to the arrest affidavit, Hernandez revealed to DPS troopers during an interview after the crash that he had smoked marijuana the night before the accident, slept for only three hours and used cocaine after waking up on the day of the collision. He also acknowledged taking a 15-minute nap in his truck before leaving the job site.
