TEXAS — Texas Attorney General Ken Paxton has sued Brittany Dawn Davis, a North Texas social media influencer with thousands of followers on Instagram and Twitter.
As first reported by the Dallas Morning News, the lawsuit concerns Davis’s former online fitness business, Brittany Dawn Fitness LLC.
The lawsuit claims the business offered online fitness and nutrition plans that were individualized for each client but that those plans were not individualized and promised coaching and check-ins never materialized.
The online packages, the lawsuit says, ranged from $92 for a one-time macro consultation to $300 for three months of personalized macros, trainings and coaching. It further says complaints were ignored or customers only received partial refunds.
The lawsuit also alleges Davis mislead customers with eating disorders, telling them she overcame her eating disorder via exercise and healthful eating. Davis, however, claims she did not accept customers with eating disorders. The lawsuit says at least 14 customers who sought refunds identified themselves as having an eating disorder.
The lawsuit is seeking up to $1 million in penalties, attorney’s fees and costs.
