The Town of Oxford says it's following the state's lead when it comes to dealing with a gym owner who reopened his business this week in defiance of the state's plans.
Oxford already gave Prime Fitness and Nutrition in North Oxford a verbal warning. The town manager says enforcement guidelines now call for a written warning, before issuing fines, and perhaps a cease and desist order.
The gym's owner Dave Blondin cites financial reasons for reopening as well as the mental health and well-being of his members. Blondin says he's disappointed by the governor's plan.
"I believe he considered it arts and entertainment, it's way more than that. It's definitely essential. I believe all businesses are essential to extent and if something wants to go in place I believe it should be people's choice. I'm just going to try to stay open as much as I can. I’ll fight, I’ll fight for the not only my business but the entire fitness industry” says Blondin.
Gyms are listed under phase three of the state's reopening plan which wouldn't start until at least six weeks from now.
Blondin says his members are willing to help pay any fines he receives. The town says they've received calls from residents to close the gym.

Not everyone is abiding by Governor Charlie Baker's ordered four phases of reopening.
Prime Fitness and Nutrition in North Oxford opened their doors yesterday, and received a verbal warning from the town. Owner Dave Blondin cites two main reasons behind his decision: First for financial reasons, saying the gym won't last if his doors are closed. And second, for the mental health and well-being of his members.
Blondin says he's disappointed by the Governor's plan, and doesn't agree gyms should be categorized in phase three.
Blondin, "I believe he considered it arts and entertainment, it's way more than that. It's definitely essential. I believe all businesses are essential to extent and if something wants to go in place I believe it should be people's choice. I'm just going to try to stay open as much as I can. I'll fight, I'll fight for the not only my business but the entire fitness industry."
Upon giving the verbal warning yesterday, Blondin said the town of Oxford said they would have to fine him if he opened again today. Blondin says his members are willing to help pay any fines he's given for going against the order and if there are extra funds leftover he'll donate them to mental health charities.
