WASHINGTON — Five men, including a man from Benton, are charged with assaulting Metropolitan Police Department (MPD) Officers during the breach of the U.S. Capitol on Jan. 6. The superseding indictment was unsealed in federal court in the District of Columbia.

Clayton Mullins is from Benton, a town in Marshall County in western Kentucky. He is accused of assaulting an officer referred to as "B.M." Mullins is also accused of assaulting a second MPD officer.

Jack Whitton, 30, of Locust Grove, Georgia was arrested Thursday, April 1, in Atlanta. The indictment accuses Whitton, along with Jeffrey Sabol of Kittredge, Colorado, and Peter Stager of Conway, Arkansas of assaulting the same officer as Mullins, but they allegedly used a baton, flag, pole, and a crutch. 

Whitton and Sabol are also accused of assaulting the same second MPD officer as Mullins. A third man, Michael Lopatic Sr. of Lancaster, Pennsylvania, is accused of assaulting a third MPD officer. 

The U.S. Attorney's Office for the District of Columbia and the Counterterrorism Section of the U.S. Department of Justice's National Security Division are prosecuting the case. They are receiving assistance from the U.S. Attorney's Offices for the Western District of Kentucky, the Northern District of Georgia, the Southern District of New York, the Eastern District of Arkansas, and the Eastern District of Pennsylvania. 

This case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Counterterrorism Section of the U.S. Department of Justice’s National Security Division, with assistance from the U.S. Attorney’s Offices for the Northern District of Georgia, the Southern District of New York, the Eastern District of Arkansas, the Eastern District of Pennsylvania, and the Western District of Kentucky.

FBI field offices in Louisville, Washington, Atlanta, New York, and Little Rock, along with the MPD and the U.S. Capitol Police are investigating the case.
