LOUISVILLE, Ky. - Vickie Jones was shopping at the Stonybrook Kroger in Jeffersontown last year when Gregory Bush exited the store and allegedly shot and killed her in the parking lot. Her son, Marcus, the executor of her estate, filed a lawsuit against Kroger and Bush in Jefferson Circuit Court.
Jones' suit clams Kroger was negligent in allowing concealed weapons on its property and the company didn't ensure patron safety at its stores. The lawsuit says Kroger employees aren't allowed to carry weapons and therefore no one working could have done anything to protect customers.
The lawsuit also accuses Kroger and alleged gunman, Bush with the wrongful death of Jones. The sudden death of the 67-year old meant her family was forced to incur medical expenses and her ability to earn money was "permanently destroyed" as a result of negligence on behalf of Kroger and Bush. Bush is also accused of battery in the lawsuit, saying he forced her to suffer pain and injury, leading to her wrongful death.
The estate of Jones is seeking repayment for all legal costs, a jury trial and punitive damages in the case.
Doctors ruled Bush competent to stand trial last month and Jefferson Circuit Judge Annie O'Connell will decide whether to accept the findings of the report at an October 31 competency hearing. He is accused of killing not only Jones but also 69-year old Maurice Stallard.
